Terms & conditions
These Terms and Conditions prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. Entry instructions are deemed to form part of the Terms and Conditions and by participating all entrants will be deemed to have accepted and be bound by the Terms and Conditions. Please retain a copy for your information.
- The Promoter: Proximo Spirits UK, 26-28 Ely Place, London EC1N 6TD
- Eligibility: This prize promotion is open to UK (England, Wales, Scotland and Northern Ireland) residents aged 18 years or over excluding employees and their immediate families of The Promoter, associated agents or anyone professionally connected with the prize promotion. No purchase necessary. Internet access required.
- Promotional Period: The prize draw opens at 00:00 on 11 December 2023 and close at 23:59 on 16 February 2024. All entries outside the Promotional Period will not be accepted.
- Entry Instructions: To enter the prize draw, scan the on-pack QR code or visit 1800tequila.co.uk to submit your details (submit name, email, address, contact number & date of birth) during the promotional period.
Entry is via the microsite only (1800tequila.co.uk). Only one entry per person per week during the Promotional Period. For the avoidance of doubt, only one entry will be accepted per person, and a person can enter only once per week.
Any entrant using multiple identities or computerised or automated systems to enter the promotion will be disqualified and any prize void. Only one prize can be claimed per household.
No third party or bulk entries. Entries via trade, third parties, consumer groups or syndicates, entries by macros or other automated means and entries which do not satisfy the requirements of these Terms and Conditions in full will be disqualified. If it becomes apparent that either a participant or household is using any means to circumvent this condition such as, and without limitation, fraudulently falsifying data, acting fraudulently or dishonestly in the opinion of the Promoter, using identities other than their own, creating fake identities or any other automated or manual means in order to increase that participant’s or a household’s entries or otherwise acting in violation of these terms, these participants and their household will be disqualified, and any prize entitlement will be void.
Entrants who make an entry on someone else’s behalf will be disqualified, at the Promoter’s discretion.
Incomplete, illegible, invalid or misdirected entries will not be accepted. Proof of sending will not be accepted as proof of entry. No responsibility can be accepted for entries that are incomplete, lost due to technical reasons, corrupted, delayed or not received for whatsoever reason.
- Prize: The prize is a ticket to the BRIT Awards 2024 for 2 adults (winner and their guest aged 18+) at the O2 arena in London, including £300 travel & expenses allowance. There are 5 prizes to give away.
The payment of £300 will be made in advance of travel by secure bank transfer to a UK bank account (or by cheque that must be cashed prior to the event if preferred) to the winner to contribute to travel and any other expenses.
Prize is subject to availability and the winner and their guest must be available to attend the BRITS Awards ceremony on Saturday 2nd March 2024. The prize excludes any personal expenses other than the allowance as stated above.
No cash or other alternative prize will be provided in whole or in part, except that in the event of circumstances outside of its control the Promoter reserves the right to substitute a similar prize, or part of the prize, of equal or greater value. The prize is non-transferable and non-refundable. The prize winner and their guest are prohibited from reselling the prize to other people or on third party websites.
- Winner Selection: The 5 winners will be drawn at random from valid entries, within 1 working day of the closing date.
- Winner Notification: The winners will be notified by email within 2 working days of the draw date. A winner will be redrawn if they have previously won or if there is a previous winner within their household. It is the responsibility of the participant to ensure that they respond to the winner notification, by emailing the address provided at the point of notification with a scanned copy of their proof of full name, age and home address. Only official documents can be accepted as proof of ID and home address (passport, driving licence, utility bill less than three months old or bank statement, for example). A mobile phone bill will not be accepted as proof of address. If the winner has not responded to the initial email notification by day 2, one attempt to call them will be made using the contact number provided. If contact cannot be made, the winner is ineligible, rejects their prize or their prize is not claimed, within 3 days of the initial prize notification date an alternative winner will be drawn using the same methodology as above. The process will repeat until an eligible winner is able to claim each prize until 28th February 2024, after which any remaining prizes will be null and void. Entrants are encouraged to monitor their email account during this time in case they are a winner. It is the responsibility of the entrant to provide correct, up-to-date details when entering the promotion. The Promoter cannot be held responsible for any winners failing to supply accurate information which affects prize acceptance or delivery of their prize.
- Prize tickets will be sent to the email address provided after valid claim and the completion of the verification process within 2 days. The notified winners are responsible for providing the correct name and email address. After valid claim and the completion of the verification process, winners will be contacted by the Promoter to make payment of the £300 travel & expenses allowance, to provide their UK bank account details via a secure process. The allowance will be fulfilled within 2 days of receipt of valid details.
- The Promoter and/or the Agency accept no responsibility if a prize cannot be delivered for any reason.
- The Promoter’s decision is final and binding. No correspondence will be entered into.
- The Promoter will make available a list of winners’ surnames and counties of residence to members of the public or regulators who request such details within 3 months of the closing date of this promotion. Entrants can object to disclosure, or request that disclosure be limited in scope by contacting 1800@cowpr.com. We may nevertheless disclose the information to the Advertising Standards Authority if required to do so. You may request a copy of the winners list by emailing 1800@cowpr.com.
- The Promoter reserves the right, at its sole discretion, to eliminate or disqualify any entries or entrants that it regards as being in breach of these Terms and Conditions or the spirit of the Promotion. Those who try and circumvent the entry process and/or entry instructions by any method or otherwise where a participant has gained unfair advantage in participating or won using fraudulent means will be disqualified and any prize award will be void.
- Entry into the Promotion is at the entrant’s sole risk. To the extent permitted by law, the Promoter does not accept any responsibility for any damage, loss, liabilities, injury, costs, expenses or claims (whether in contract, tort or otherwise) suffered by entrants or any third parties arising out of or in connection with the Promotion and/or accepting a prize. The Promoter further disclaims liability for any injury or damage to entrants or any other person relating to or resulting from participation with this Promotion save that nothing in these Terms and Conditions shall act to limit or exclude the Promoter’s liability resulting from its negligence or fraud or for any liability which cannot be excluded by law (including personal injury, death and fraud).
- The Promoter has no control over internet or communication networks and is not liable for any problems associated with them due to traffic congestion, technical malfunction or otherwise. The Promoter will not be held liable to any individual for any fraud committed by any third party nor for any event beyond its control including, but not limited to, user error and any network, computer, hardware or software failures of any kind which may restrict, delay or prevent a participant’s entry to the promotion.
- The Promoter reserves the right to cancel, amend, withdraw, terminate or temporarily suspend this Promotion or invalidate any entries in the event of any unforeseen circumstances or technical reason outside its reasonable control, with no liability to any entrants or third parties but will use all reasonable endeavours to avoid consumer disappointment. Such circumstances include, but are not limited to: industrial action, civil unrest, fire, flood, storms, earthquakes, acts of terrorism, acts of war, governmental action computer virus, network failure, traffic congestion, bugs, tampering, unauthorised intervention, fraud, technical failures or any other event that is beyond the control of the Promoter.
- If any of these clauses should be determined to be illegal, invalid or otherwise unenforceable then it shall be severed and deleted from these Terms and Conditions and the remaining clauses shall survive and remain in full force and effect.
- The application and interpretation of these terms and conditions shall be governed by the law of England and the courts of England and Wales shall have exclusive jurisdiction in relation to any dispute concerning them unless you live in another part of the UK, in which case your local courts will have jurisdiction.
- The Promoter will only use the personal details supplied for the administration of the promotion and for no other purpose unless we have your consent. Your data will be passed onto a third-party fulfilment agency for the purposes of administering the prizes. This data will be kept secure and in accordance with the requirements of current Data Protection legislation. Entrants’ personal data will be used and held in accordance with the Promoter’s Privacy Policy at /privacy-policy/ and the agency’s Privacy Policy at www.thisiscow.com Data will be stored for 3 months after the promotion end date then deleted. You can request access to your personal data, or have any inaccuracies rectified, by sending an email to 1800@cowpr.com. By participating in the promotion, you agree to the use of your personal data as described here.
